With new developments springing up throughout England and Wales to accommodate our growing population, it is vital that potential purchasers are given all the information available when it comes to existing and likely planning permissions that may affect the enjoyability of their new home.

In the news recently, it was reported that international law firm Bird and Bird had been ordered to pay nearly £2m in damages after it was found liable for breach of duty after failing to disclose information pertaining to the development of an academy school development in the vicinity of a £25m seven-bedroom property on which a deposit had already been paid.

In court, the judge ruled that because Bird and Bird had carried out a plan search report on the property during the conveyance which showed the planning permission, that they were under a duty to explain the results to the purchaser. In failing to do so, they were liable for legal fees and a share of the hefty £2.5m deposit when it was later discovered and the sale was aborted.
